1. Real Property Gains Tax (“RPGT”)

Real Property Gain Tax is chargeable for any sale of properties within the first 5 years at a rate of 5%.

2. Foreign Exchange Administration Policy

Effective 1st April 2007, the foreign exchange administration rules will be liberalised and there will be no limit on the number of residential property loans obtained by foreigners.  Previously, foreigners were allowed to obtain a maximum of three (3) property loans to finance the purchase of properties in Malaysia. 3. Foreign Investment Committee (FIC)

Foreigners are exempt from obtaining approval from the FIC for the purchase purpose of residential property exceeding RM250,000 per unit with no limit on the number of properties acquired and usage control. For latest updates or verifications, you can contact :

4. Malaysia My Second Home (MM2H)

Malaysia is both politically and economically stable and has lots to offer with its perfect combination of comforts and indulgences : great weather, amazing food, warm people, high standards of living but cheap cost of living, state-of-the-art infrastructure, rich multi-culture and the list goes on and on.  

Many have come to Malaysia and fallen in love with it, coming back repeatedly or even making plans to retire here.  In this essence, the Malaysian Government has set up a programme to make it easier for expatriates to retire here via the “Malaysia My Second Home Programme” (“MM2H”).

MM2H is open to all foreign citizens wishing to retire or reside in Malaysia on a long term basis. It is fully endorsed by the Government of Malaysia and your immediate family [dependants and one (1) maid] can also participate in the programme.  Terms and conditions of the programme are appended below :

4.1 Eligibility

Open to all foreign citizens except Israel, Montenegro & Yugoslavia.

4.2 Age, financial requirements and withdrawal conditions

Terms and Conditions

For applicant aged below 50

- Perform a medical checkup and purchase medical insurance in Malaysia (applied to applicant, spouse and children aged below 18 years old)
- Open a Fixed Deposit account of RM300,000
- After a period of one year, you may withdraw up to RM150,000 for approved expenses relating to house purchase, education for children in Malaysia and medical purposes.
- A minimum balance of RM150,000 must be maintained throughout your stay in Malaysia under this programme.

For applicant aged 50 and above
- Perform a medical checkup and purchase medical insurance in Malaysia (applied to applicant, spouse and children aged below 18 years old)
- Open a Fixed Deposit account of RM150,000.00
- After a period of one year, you may withdraw up to RM90,000 for approved expenses relating to house purchase, education for children in Malaysia and medical purposes. You may withdraw this sum to pay for your residential property in Malaysia.
- A minimum balance of RM60,000 must be maintained throughout your stay in Malaysia under this programme.

Fixed Deposit Reduction
- An applicant who has purchased property in Malaysia totaling above RM 1 mil and paid up at least RM 300,000 (aged below 50) or RM 150,000 (aged 50 and above), can apply to open Fixed Deposit of only RM 60,000.

4.3 Insurance coverage and medical report

A valid Medical Insurance Policy together with a recognised Medical Report is required

4.4 Sponsors / Assistance

There is no requirement for a Malaysian sponsor.  If you need assistance in making the application, we can assist in the application process.

4.5 Agents fee : Up to RM10,000 for assistance

Visa Fee : RM 90.00 per year is charged for issuance of Social Visit Pass.

4.6 Incentives

A. House Purchase
Participants under MM2H are allowed to purchase unlimited units of residential property valued over RM250,000 per unit.

B. Car Purchase
Choice of either importing one (1) car from country of origin, subject to Approved Permit and exempted from payment of Import & Excise Duty and Sales Tax (within 6 months from the endorsement of MM2H pass) OR purchase one (1) locally made car, exempted from payment of excise duty & sales tax (within 1 year from the endorsement date of MM2H pass)

4.7 Education

Applicants are allowed to bring along their dependants, either not schooling or are schooling in primary, secondary or in any institution of higher learning.  However, dependants who are schooling are required to apply for a Student Pass to continue their education in schools or colleges recognised by the Government.

4.8 Taxes

Successful applicants are bound by the policies, systems and regulations of taxes of this country.  However, their overseas income will not be taxed in Malaysia.

4.9 Security Vetting

Approvals are given subject to security vetting clearance conducted by the Royal Malaysian Police.

4.10 Restrictions

Successful applicants are strictly forbidden from the following :
Being employed anywhere in Malaysia. However if the applicants are interested to practise his/her trade in Malaysia, they can write to the Human Resource Ministry to apply for work permit. At retirement they can rejoin MM2H programme.
Participating in activities that can be considered as sensitive to the local people like politics or missionary activities.

Processing Period :
The approval of your application is subjected to evaluation by the Immigration Department and the Ministry of Tourism Malaysia. Conditional approval will be given within 30 working days after submission of documents.

Upon conditional approval, applicants are given 6 months to open FD account and purchase medical insurance. After submitting proof of the above, it takes at maximum 7 working days before Social Visit Pass is issued.

In line with the Immigration Circular No. 6 of 2009, the following improvements have been made to the Malaysia My Second Home (MM2H) Programme, with effect from 13 February 2009:

1. Qualified MM2H participants aged 50 and above with specialised skills and expertise that are required in the critical sectors of the economy, are allowed to work not more than 20 hours per week.

The approval to work part-time is subject to the following conditions:

a) the application is approved by the MM2H Special Committee;
b) the work contract needs to state that the MM2H participant is working part time and to attach the work schedule; and
c) total number of hours of week does not exceed 20 hours.

2. MM2H participants are allowed to invest and actively participate in business, subject to existing Government policies, regulations and guidelines which are in force for the relevant sectors. 

3. Foreign spouses of Malaysian nationals are eligible to apply for MM2H, subject to the terms and conditions of the MM2H programme. Alternatively, they have the option to apply for the Spouse Programme.

4. The ten-year Social Visit Pass is extended to all Silver Hair and MM2H participants who were previously approved under the five-year Social Visit Pass, subject to the validity of their passports.

5. Employment Pass holders who wish to participate in the MM2H programme are exempted from the “cooling off period” on the condition that their application to participate in MM2H programme is submitted 3 months before the expiry of the Employment Pass.

6. ID-Cards will be issued to MM2H participants with permanent address in Malaysia. This is validated by submitting the Sales and Purchase Agreement or Tenancy Agreement in Malaysia. 

7. Age limit of unmarried dependent children is raised from 18 years to 21 years. A declaration stating that the child is unmarried and all expenses during the stay in Malaysia will be borne by the principal participant of the MM2H program is required.

8. ‘Dependants’ include unmarried children aged 21 years and below, step-children, disabled children and parents.
